HIPAA Notice of Privacy Practices

This notice describes how medical information about you or your child may be used and
disclosed and how you can get access to this information.
PLEASE READ CAREFULLY.


This Notice of Privacy Practices is NOT an authorization. It describes how we, our Business Associates and their subcontractors, may use and disclose your Protected Health Information (PHI) to carry out treatment, payment, or health care operations and for other purposes that are permitted or required by law. It also describes your rights to access and control your Protected Health Information. “Protected Health Information” (PHI) is information, including demographic information, that may identify your child and that relates to the past, present, or future physical or mental health condition and related health care services.


1. USES AND DISCLOSURES OF PROTECTED HEALTH INFORMATION (PHI): PHI may be used and disclosed by your physician, our office staff, and others outside of our office that are involved in the care and treatment for the purpose of providing health care services, to obtain payment for services, to support the operation of the physician’s practice, and for any other uses required or permitted by law.


2. Treatment: We will use and disclose your PHI to provide, coordinate, or manage health care or any related services. This includes the coordination and management of health care with a third party. For example, a referred physician
will have necessary information to diagnose and treat your child.


3. Payment: PHI will be used and disclosed to obtain payment for services rendered, including billing, claims management, eligibility determinations, and collection activities.


4. Reminders / Appointments: We may use PHI to contact you by phone, voicemail, text message, mail, email, or patient portal for appointment reminders, follow-up care, newsletters, or announcements about special events.


5. As Required by Law: We must disclose PHI about you without authorization if federal, state, or local laws require us to do so or if disclosure is necessary to prevent or lessen a serious threat to health or safety.


6. Judicial Proceedings: We may disclose PHI in response to a court order, subpoena, or other lawful process as permitted by law.


7. Inspect and Copy: You have the right to inspect and obtain a copy of your child’s PHI. Requests must be made in writing. Reasonable, cost-based fees may apply as permitted by the State of Delaware.


8. Right to Amend: If you believe that any PHI we maintain is incorrect or incomplete, you have the right to request an amendment. Requests must be made in writing. We may deny your request if the information was not created by us, is not part of the designated record set, is not available for inspection, or is accurate and complete. If the request is denied, you will be notified in writing.
 

9. Confidential Communications: You have the right to request that we communicate with you by alternative means or at an alternative location.
 

10. Restricted Use: You may request restrictions, in writing, on certain uses or disclosures of your PHI. We are required to comply with a request to restrict disclosure of PHI to a health plan for services paid in full out-of-pocket at the time
of service.

 

11. Right to Accounting of Disclosures: You have the right to receive an accounting of certain disclosures of PHI made by us as required by law, except for disclosures made for treatment, payment, health care operations, or those authorized by you.
 

12. Breach of PHI: You will be notified in accordance with federal HIPAA requirements if your unsecured PHI has been breached.
 

13. Paper Copy of This Notice: You have the right to receive a paper copy of this notice upon request. This notice is available at our reception desk and on our website at www.beaconpediatrics.net.
 

14. Health Care Operations: We may use and disclose PHI for health care operations, including quality assessment and improvement activities, staff training, credentialing, licensing, accreditation, audits, business management, and general administrative activities.
 

15. Public Health and Oversight Activities: We may disclose PHI for public health activities, reporting abuse, neglect, or domestic violence, health oversight activities, workers’ compensation, law enforcement purposes, and other government functions as permitted by HIPAA and applicable Delaware law.
 

16. Complaints: You may file a complaint with Beacon Pediatrics, LLC, the Delaware Department of Justice – Consumer Protection Unit, or with the Secretary of the U.S. Department of Health and Human Services if you believe your privacy rights have been violated. Complaints must be filed within 180 days of when you knew or should have known of the violation. There will be no retaliation for filing a complaint.

18. Changes to This Notice: We reserve the right to change the terms of this Notice at any time. Any changes will apply to all PHI we maintain. The revised notice will be available in our office and on our website.
